Warner Board of Selectmen Meeting Minutes April 4, 2006

The Selectmen reviewed a request to renew a building permit for Map 33 Lot 2 from 2001 that is approximately 40 % complete. Selectman Eigabroadt made the motion to renew a building permit for Map 33 Lot 2 along with waiving the fees. Chairman Hartman seconded the motion. The motion passed. The Selectmen verified that the cost to survey Old Davisville Road would be paid from the Highway Block Grant. Selectman Eigabroadt made the motion to allow Public Works Director Allan Brown to expend $1,200.00 from the Block Grant to survey Old Davisville Road. Chairman Hartman seconded the motion. The motion passed. Selectman Eigabroadt made the motion to approve building permits for Map 30 Lot 5, Map 36 Lot 4, Map 1 Lot 8. Chairman Hartman seconded the motion. The motion passed. Selectman Eigabroadt made the motion to approve a Timber Tax Levy Warrant for Map 16 Lot 70, Map 9 Lot 14, Map 5 Lot 11, Map 4 Lot 6 amounting to $6,291.79. Chairman Hartman seconded the motion. The motion passed. Selectman Eigabroadt made the motion to approve Veterans Tax Credits in the amount of $500.00 for Map 15 Lot 46-3. Chairman Hartman seconded the motion. The motion passed. Selectman Eigabroadt made the motion to approve Veterans Tax Credits in the amount of $500.00 for Map 25 Lot 40. Chairman Hartman seconded the motion. The motion passed. Selectman Eigabroadt made the motion to approve Veterans Tax Credits in the amount of $500.00 for Map 34 Lot 16. Chairman Hartman seconded the motion. The motion passed. Jonathan McNeal a representative from Cingular Wireless met with the Selectmen to discuss proposed construction (cell tower) on a Class VI road off of Waldron Hill Road (Old Tewksbury Road). Cingular is willing to sign a waiver of rights because it would be an unmanned facility. The proposed tower is going before the Zoning Board for a special exception for the tower on April 12 and then back to the Planning Board. Mr. McNeal met with the Selectmen to hear their concerns regarding the Class VI road. Selectman Eigabroadt explained that the Town has a policy that does not allow construction on a Class VI road without first upgrading to a Class V. Mr. McNeal understands that the Selectmen would not want Old Tewksbury road upgraded to a Class V because that would add to the infrastructure. The Selectmen need to review and consider the information submitted by Mr. McNeal, another meeting will be scheduled for further discussion. Mr. McNeal was also instructed to send a letter to the Selectmen outlining their proposal. Administrators Report: Code Enforcement – There were a couple of code enforcement issues that were investigated this week as follows: Abbondanza – Mr. Abbondanza was excavating material from his property on Morse Loop and a Cease & Desist order was issued. The order allows 10 days to remove the equipment and 20 days to submit a reclamation plan. Selectman Eigabroadt asked the Town Administrator if she was aware that a "Notice of Violation" for stockpiling material and storing equipment was previously served to Mr. Abbondanza and the next step would be "summons to district court". Ms. Buono understood the previous notice was for stockpiling material which is no longer there. Selectman Eigabroadt further explained that the "Notice" was for the stockpiling of materials, equipment and zoning violations. Mr. Abbondanza did stop working on the property after being served up until recently. Selectman Eigabroadt took pictures for the file two days after the Town Administrator served the Cease & Desist order. Selectman Eigabroadt recommends following up with the summons to district court based on the evidence that is on file. The Selectmen’s office has not yet received a reclamation plan from Mr. Abbondanza. Albano – It was discovered that a structure has been built on the Albano property located on West Joppa Road. The area in question has been taken out of current use by the Assessing Department and a penalty will be sent once the proper signatures are on the form. The property owner will be contacted by telephone before the letter is sent to verify acknowledgement of the structure. Firth – Progress on the Firth property on Cunningham Pond Road was looked into. Very little has been accomplished. There is a trailer with an attached deck on the property along with an outbuilding, rabbit hutch and goose pens. It appears in the file that the deck was supposed to be dismantled and removed by July 15, 2005. A reminder letter will be sent to Mr. Firth regarding the permission to live in the temporary trailer expires May 31, 2006. If compliance is not met by May 31, 2006, on June 1, 2006 a "Cease & Desist" order will be issued ordering the removal of the trailer and all out buildings. Haight – A cease and desist was drawn up for the Haight property, Map 22 Lot 2, as discussed at the last Selectmen’s Meeting which needs the Chairman’s signature. Racy – Selectman Hartman and Allan Brown met with Mr. Racy on Runnels Loop with regard to his concerns about the runoff that always used to be present on his property. Mr. Racy claims that his neighbor made alternations to the drainage system so that the runoff now goes onto their property instead of his. Mr. Racy wants the runoff returned to his property. On the surface, based on information provided by Chairman Hartman and Allan Brown (pictures were taken) there doesn’t appear to be any evidence that the vegetation was disturbed however; Allan Brown will look into the situation further. Mr. Racy says that the alterations took place within the last two years. Chairman Hartman noted that there is a trash pile on Mr. Racy’s property that shows no disturbance, the pile is located on top of the sub-terrarium culvert that goes out of one of the catch basins. Mr. Brown will meet with Mr. Racy’s neighbor. Riverside Park – Capital Well has drilled a pilot hole for the well at Riverside Park and has ordered the screen for the project. They are planning to be back at the property this week to continue with the project. Month Ends – Wendy Pinkham has distributed copies of the month ends from January – March to each of the Selectmen for their information. Ms. Buono has also received a copy and will review them this week for informational purposes. Depot Road – Ken Benward, building inspector and Ms. Buono went to the apartments on Depot Road on April 3rd to inspect the structural concerns that have been brought forward. Several issues with the front porch were noticed such as unstable beams which are rotted at the bottom, stairs to the second level (outside) which do not meet code by way of an open space at the top and handrails that are unstable and do not have the proper balusters. The property owner will be noticed. Code Enforcement/Health Officer – Due to the number of code enforcement issues that came up this week and the potential for more as the Town continues to grow, coupled with the fact that there is a need to fill the Health Officer position Ms. Buono suggested that these positions be combined since they really go hand in hand. It may be a good time to review the need for a part time person to fill this roll. For the present time the responsibility falls onto the Selectmen. 14 Pleasant Pond – Ms. Buono spoke with Local Government Center with regard to liability on the part if the Town should a Certificate of Occupancy be issued on this property. Although LGC feels there may be some liability, there are ways to minimize that liability. LGC suggested that Ms. Buono speak with the State Fire Marshall and the State Manufactured Installation Standards Board. Ms. Buono is awaiting return contact from the Fire Marshall’s Office and the State Board. Klinedinst Letter – If this letter is ready to be sent, Ms. Buono will place it on town letterhead for a signature. Ruff – There were no changes sent to Ms. Buono for the letter to the Ruff’s regarding zoning violations, so once the letter is signed it will be sent via certified mail. Tax Collector, Marianne Howlett requested a change of due date for a Timber Tax because the property owner has been out of state, the Selectmen approved the request. An annual list was presented to the Selectmen, if the Selectmen choose not to deed a particular property it would need to be submitted in writing to the Tax Collector. The Selectmen were also asked to approve the use of Goulett Computer Consultants; they have been used since 2003 to process new liens at a cost of $13.00 per parcel (this cost has not increased since 2003). The Selectmen approved and signed the contract for Goulett Computer Consultants. Mrs. Howlett also noted to the Selectmen that if they chose to grant any of the listed deeded properties an extension before the deadline then an extension would need to be granted to all. Selectman Eigabroadt made the motion to approve meeting minutes date March 28, 2006. Chairman Hartman seconded the motion. The motion passed. The Town Administrator notified the Selectmen that an offer of employment has been made for the Highway Department pending test approval. Chairman Hartman and Ms. Buono will attend a Transfer Station and Recycling center workshop on April 5th. Selectman Eigabroadt informed the Board that during the April 3 Planning Board meeting approval was granted to Cingular Wireless to co-locate on the Kearsarge Mountain tower.
