Meeting Minutes

April 20, 2004

 

Chairman Brayshaw opened the meeting at 5:30 p.m.

In attendance: Selectman John C. Brayshaw – Chairman, Selectman Allen C. Brown and Selectman Peter St. James.

Recorder of the minutes is Mary Whalen.

Chairman Brayshaw made the motion to go into non-public session per RSA 91-A; 3 II (b), Selectman Brown seconded the motion. All were in favor.

Chairman Brayshaw made a motion to close the non-public session and open the public session. Selectman Brown seconded the motion. All were in favor. Chairman Brayshaw made a motion to seal the minutes. Selectman St. James seconded the motion. All were in favor.

Paul Fouliard met with the Selectmen and informed them that if the dumpsters are not dealt with, the Town can expect to see at least a 25% overage in the tonnage to Concord Regional. At the end of March the Town is at 31.04%. Mr. Fouliard recommends immediately dealing with the homeowners that have dumpsters.

Finance Director Wendy Pinkham met with the Selectmen and informed them about the billing from the Water Precinct regarding a sewer main break. Mrs. Pinkham spoke to the supervisor from District V (D.O.T) who informed Mrs. Pinkham that the State provided the labor, catch basins and the culvert pipe. The Town of Warner broke the sewer main pipe while digging. The Water Precinct supplied the replacement pipe and clamps for the repair. It has been agreed by the Water Precinct to incur half the cost of the repair. Selectman St. James made the motion to have the Finance Director pay half the cost ($879.13) to the Water Precinct for the repair to the sewer main break. Selectman Brown seconded the motion. All were in favor. Mrs. Pinkham asked the Selectmen to review a garment loss protection plan from E&R Cleaners. A decision needs to be made by May 1, 2004.

Mr. & Mrs. Heaton met with the Selectmen to express their interest in a portion of land that abuts their property on Pleasant Lake. The land that they are interested in is part of the property that will be the Town’s gravel pit and has frontage on Pleasant Pond. The Selectmen will take Mr. Heaton’s request under advisement.

Mr. Kyle Whitehead met with the Selectmen in regards to a "Home Occupation Permit" for timber frame shop operation. The Permit has been before the Planning Board and it was determined that a Site-Plan was not required. Selectman Brown made a motion to approve the "Home Occupation Permit" for a timber frame shop operated by Mr. Kyle Whitehead. Selectman St. James seconded the motion. All were in favor.

Mr. Marc Violette met with the Selectmen as representative to the Warner Business Association. The WBA would like to make a donation to the Town of Warner in the amount of $2,290.00. The donation will replace the fence in front of the Town Hall with a granite post split rail fence. A Public Hearing will be noticed to accept the donation.

Barbara Annis, Martha Mical along with Mary Pinkham Langar from the Department of Revenue Administration met with the Selectmen to discuss the processing of "Intents to Excavate". Prior to 1998 the Legislature had a study committee which established RSA 72-B that is to be read in conjunction with RSA 155-E in that it was to provide a state wide regulatory framework for the excavation of earth. RSA 155-E is a local regulation of earth excavation and is administered by the municipality; the regulator by statute is the Planning Board unless otherwise voted. It was also determined that there are no gravel pits completely exempt (grandfathered). RSA 485-A 17, site specific through Environmental Services, whatever was opened and disturbed as of May 1981 could be expanded an additional 2.3 acres before a "site specific" is required. The Regulator (Planning Board) can also request a bond from a gravel pit owner pertaining to reclamation. Barbara Annis asked how the Planning Board begins regulating the current gravel pits. The Planning Board needs to obtain copies of the recent intent to excavate. Then locate plans/permits that may have been submitted and create files. The Planning Board needs to catch up with the intents that have been filed.

Martha Mical and Marianne Howlett met with the Selectmen to discuss the implementation of penalty fees for inventory forms that have missed the deadline date of April 15. Penalties are as follows; any person or corporation who fails to file an inventory of taxable property under RSA 74-7A shall be assessed a penalty equal to 1% of the property tax and not less than $10.00 or more than $50.00, late filing may result in loss of the right to appeal the property tax assessment. Chairman Brayshaw is not in favor of the inventory form. Selectman St. James asked if there is a way to advise the property owners who have not completed the form that there is a penalty. The Selectmen extended the deadline date to May 1, 2004.

Mr. John Cowan from Highspeed Communications met with the Selectmen and presented a profile of the services that they provide for a telecommunication system in the Town Hall offices. Mr. Cowan answered the Selectmen’s questions and questions from the office personnel. Mr. Cowan will provide an updated proposal based on the information provided by the Selectmen.

On October 23, 2001 a motion was made to have the Intents-to-Cut process return to the Selectmen’s Office. The Intents are currently processed through the Assessing Clerk’s office. After discussion between the Selectmen and with the Assessing Clerk it was decided to leave the processing of the Intents with the Assessing Clerk.

The Selectmen’s office will advertise the Building Inspector position on cable and in the local paper.

Selectman St. James made a motion to abate interest accrued amounting to $1,422.86 for tax year 2001 and 2002 on Map 12 Lot 29. Selectman Brown seconded the motion. All were in favor. The motion passed.

Chairman Brayshaw made a motion to approve the following job descriptions, laborer, heavy equipment operator, Health Officer, Finance Director, Director of Welfare, Director of Emergency Management, Deputy Town Clerk, Deputy Fire Chief, Transfer Station Department Head. Selectman Brown seconded the motion. All were in favor.

Previously signed by the Selectmen; four applications for current-use, Warrant for the collection of gravel pit excavation tax, and thirty abatement requests. The Selectmen proceeded to review four building permits.

Melvin Herbert and Tricia Orr met with the Selectmen to discuss a logging operation that is taking place behind their property. The Assessing Clerk explained that every other tree may be cut on the boundary line, slash cannot be left within 25 feet of the boundary line.
