Warner Board of Selectmen Meeting Minutes May 29, 2007
Meeting opened at 6:04 p.m. In Attendance: Selectman David E. Hartman – Chairman, Selectman Richard A. Cook, Selectman Wayne Eigabroadt Absent: No Members Absent Recorder of the minutes is Mary Whalen Others Present: Rick Deschene, Peg Bastein, Martha Mical, Mary Whalen, David Herrick, Mike Ritter, Mike Russo 1. BUILDING PERMITS The Selectmen have received clarification regarding RSA-155 (State Building Code) from Local Government Center. It was clearly defined that interior permits are required. The Selectmen will meet with Mary Whalen and Building Inspector Ken Benward during the June 12th Selectmen’s meeting to discuss details for implementing interior building permits. 2. PINE ROCK MANOR – DRAINAGE Rick Deschene met with the Selectmen to discuss the on-going drainage and hazard issue in front of Pine Rock Manor located on Denny Hill Road. Rick has a driveway that is in need of repair and cannot complete the repairs until the drainage problem is remedied on Denny Hill Road. Rick has met with the Director of Public Works who recommends at a minimum installing 2 catch basins and a culvert. Knowing that the reconstruction project for Denny Hill Road was canceled and with the recent flooding, Rick feels the issue is becoming critical. During the recent April storm both the Town’s and Pine Rock’s culvert’s backed up and there was water across the road. Rick is asking the Selectmen to consider placing the required culverts on the Highway Department’s agenda. Selectman Cook explained that a Road Committee has developed a sufficiency rating system for the roads in order to identify the most critical ones. A report will be generated and presented to the Capital Improvements Program and Board of Selectmen in order to determine priorities. Denny Hill Road has been identified as one of the critical roads. Chairman Hartman explained that there is no extra money in the budget to complete this project, however if Mr. Brown has means within his budget, then repair can be considered. Rick explained that he had previously applied for funding through HUD based on the Town’s schedule; since work was never completed he lost the funding. Rick is asking for a firm commitment from the Town in order to apply for funding again. The Selectmen will conduct a site visit on June 5 with the Director of Public Works in order to consider Rick’s request. Rick will be notified about the Board’s decision. 3. CONSERVATION COMMISSION ALTERNATE Peg Bastein met with the Selectmen with interest in filling an alternate vacancy on the Conservation Commission. Peg is interested in giving back to the community. Peg is an environmental engineer and has been attending the Conservation Commission meetings for over a year and has volunteered to help with the natural resource mapping. Selectman Cook made the motion to appoint Peg Bastein as an alternate member to the Conservation Commission until 2010. Selectman Eigabroadt seconded the motion. All were in favor. The motion passed. 4. ABATEMENTS Martha Mical presented abatements that were reviewed and approved by the Assessor. Selectman Cook made a motion to approve the recommended abatements for the following properties Map 19 Lot 34, Map 29 Lot 7, Map 11 Lot 44, Map 51 Lot 50, Map 10 Lot 101-3 and Map 14 Lot 22. Selectman Eigabroadt seconded the motion. All were in favor. The motion passed. 5. MIKE RUSSO – DUST CONTROL Mike Russo met with the Selectmen to obtain an update on the dust control issue contributed by Warner Aggregate. David Herrick and Mike Ritter from Warner Aggregate reported that they are waiting on material called "Dust Stop", in the mean time Mr. Russo has asked Warner Aggregate not to use calcium chloride. Mr. Herrick will begin water application to control the dust until the Dust Stop arrives. Speed bumps have been added in two locations along with 10 m.p.h. speed limit signs. Mr. Herrick is still researching another source that will provide an alternate egress. Chairman Hartman noted that he recently attended the Davisville Flea Market and noticed that the activity caused an enormous amount of dust. In the past Mr. Russo has stated that the Flea Market is not the problem, Chairman Hartman disputes that just from personal experience. Mr. Russo explained that before the trucks from Warner Aggregate used the road, the dust was not a problem from the flea market. Mr. Russo and Warner Aggregate will continue positive communications. Mr. Herrick noted that they have found other products comparable to Dust Stop which can be used if the current vendor does not work out. 6. GENERAL BUSINESS The Selectmen received in writing a letter of intent from Tom Dunne requesting permission to operate a mobile farm stand in Warner on Friday’s and Saturday’s selling bread in a wood-fired clay oven, eggs, fruits and vegetables. Based on Mr. Dunne’s last visit with the Selectmen it is assumed that he would like to conduct business on a piece of property that does not have a primary structure or residence on it located in a residential zone. Selectman Eigabroadt does not feel that this type of activity is allowed especially when Mr. Dunne has already been denied permission from the Zoning Board to have a farm stand. Selectman Cook would still like to look into the mobile aspect of the request. The Selectmen will ask for clarification from Mr. Dunne regarding the length of time the mobile stand would be in operation. Selectman Cook will contact the Town of Hopkinton in respect to the corn stand that is located near Colonial Village. Selectman Eigabroadt made a motion to approve a reimbursement in the amount of $8.50 for vehicle registration overpayment to Timothy Courser. Chairman Hartman seconded the motion. Selectman Cook abstained. The motion passed. Chairman Hartman asked the Board if they wish to send a donation on behalf of Laura Buono’s father-in-law who recently passed away. Selectman Eigabroadt made the motion to send a $50 donation to the Norhtshore Cancer Center on behalf of Carmine Buono. Selectman Cook seconded the motion. All were in favor. The motion passed. Selectman Eigabroadt is on the Capital Improvements Committee and has been assigned the Selectmen’s office. All requests are due by the end of June. Selectman Eigabroadt thanked the Conservation Commission for their efforts in gathering information regarding a gravel pit. Chairman Hartman is a candidate for the Northeast Resource Recovery Association Board of Directors. The annual conference is Monday, June 4. Household Hazardous Waste monthly collection begins on June 2. The Director of Public Works, Foreman and the Emergency Management Director met with a FEMA representative and visited the April 2007 flood damage. Selectman Eigabroadt as Health Officer has received complaints regarding a failed septic located at Pleasant Lake Estates. Selectman Eigabroadt inspected the complaint and will be failing 3 of the systems. Selectman Eigabroadt will be discussing his concerns with the Planning Board regarding code enforcement violations. Selectman Eigabroadt made the motion to nominate Chairman Hartman as Selectmen’s representative to the Budget Committee. Selectman Cook seconded the motion. All were in favor. The motion passed.
