Warner Board of Selectmen Meeting Minutes Tuesday, June 9, 2009 Chairman Karri ck opened the meeting at

Barbara Annis Chairman Karrick opened the meeting by
reporting the court case between the Fire Department, Town of Warner v.
Michelle Smith has been settled out of court.
The settlement is available to the public in the Town Clerk’s
office. The Board of
Selectmen thanked the Fire Department for their selfless service to the
citizens and surrounding communities. The Board of Selectmen reiterated their full support for the
Town Administrator. The
Town has benefited from her extensive knowledge of State and Municipal
Laws and her years of experience in Town Government. 1. Chipper Quotes Director of Public Works, Allan N. Brown
presented four quotes from three different companies to the Selectmen.
One company has been in business for 25 years the other 8 months. Mr. Brown has the opportunity to try the chipper he prefers
for a period of time. Based
on Mr. Brown’s recommendation Selectman Hartman moved
to authorize the Director of Public Works to proceed with the trial and
purchase of a brush chipper made by Morbark as quoted in their proposal
without exceeding $40K. Selectman
Carson seconded the motion and encourages Mr. Brown to look into setting
up a program for chipping Christmas trees.
Jerry Marsh recommends monitoring the hour meter on the chipper.
Chairman Karrick called for a vote on the motion; all were in
favor, the motion passed. Mr.
Brown confirmed that if the trial run for a smaller chipper does not
work out that he could then purchase the larger chipper.
The Selectmen said, yes. 2. Connors Mill Bridge Allan N. Brown reported the steel beams
were delivered and installed on June 8th.
3. Transfer Station Fees Transfer Station Foreman, Varick Proper
reported to the Selectmen a tire program that Northeast Resource
Recovery Association has. The
program offers ten ton pick-ups at a cost of $110 per ton or pick-up as
needed. One problem would
be storing a significant amount of tires; another is keeping the tires
dry. Mr. Proper said this
program could be considered for the coming years because of increased
tipping fees. Selectman
Hartman asked if the $110 per ton includes transportation costs.
Mr. Proper will ask NRRA. Currently
tires are added into the compactor.
The new fees for disposing tires will be: Tires (no rims) 14” – 19”
$2 each 20” – 22”
$5 each 22” & up
$10 each Any Rimmed Tires
$5 each Selectman
Hartman reported that he spoke with a vendor about tire shredders at the
recent NRRA conference. He
noted only truck tires are shredded for use as contact surface as they
do not have steel belts. Chairman
Karrick asked what the NRRA recycling program does with the tires.
Mr. Proper said they broker them and some of the shredded tires
are used as a cushion in lined landfills.
Selectman Carson asked if the Town used the NRRA recycling
program would that lessen the amount going into the dumpsters.
Mr. Proper said yes, but at an expense. Electronics Laptop computers

Hartman asked if there are more types of electronics that could be
included in the list. Mr.
Proper said items such as radios; the fee would depend upon the size.
Selectman Carson added that items such as cell phones can be
donated, he said he would obtain more information.
Demo
Material: Mr. Proper has researched what has been pulled so far this
year and what has been received in fees, currently there is only a $326
deficit. Selectman Carson
said historically the demo has never run that close is it because of
better estimates. Allan
Brown said the attendants are charging more for the demo material. Jan
Dyment commented that in 2007 there were only 2 pulls for demo material
costing $1,600 in tipping fees and in 2008 tipping fees were $19,000,
she asked for an explanation. An
audience member said everything was being stockpiled instead of being
shipped out. Mr. Brown
explained based on his memory a few years ago the highest tonnage he
remembers is 220 tons of demo material, and then it suddenly changed to
two loads of demo material per year.
Mr. Brown questioned as to what happened to all that demo
material, the economy was doing fine up until this year.
The Town recently received the test results from the ash pile
that has been untested for 5-6 years, it has been deemed as hazardous
waste. The results of the
test are from burning wood with lead paint and pressure treated wood;
the arsenic and lead levels are extremely high.
The results from the ash explain that some of the demo material
was burned. Old test
results were compared to the new tests results.
Judith Rogers offered another option; residents may have recycled
the demo material. Mr.
Brown does not feel that the residents taking from the demo pile
resulted in 200 tons of recycling.
Audience
members had various other questions about the demo.
The Board of Selectmen directed the meeting back to demo fees at
the Transfer Station and recommended to the audience members to contact
the Selectmen’s office if they wish to be placed on the next agenda to
further discuss demo material at the Transfer Station. Mr.
Proper continued on with the change in fees for large exercise
equipment; one problem is the many different materials there are on
exercise equipment. Mr.
Proper is recommending a $5 fee unless disassembled.
There
will no longer be a disposal fee for: toilets, sinks, un-upholstered
furniture, automotive batteries, fluorescent bulbs, or other mercury
containing devices. All other fees will remain as they are.
There are places where residents can take fluorescent bulbs at no
cost such as Lumber Barn and maybe even Aubuchon Hardware.
Selectman
Hartman moved to approve the proposed changes in disposal fees at the Transfer
Station. Selectman
Carson seconded the motion. Selectman
Carson asked when the fees would become effective.
The change in fees will begin on July 1, 2009.
All were in favor of the motion; the motion passed.
4. Edelmann
Discretionary Easement Selectman
Hartman explained that he was not prepared and asked to table the
evaluation until June 23. Assessing
Clerk, Martha Mical asked once the Selectmen make their decision, and if
the decision is in favor of the preservation easement that the Assessors
visit the site in order to obtain the new value with no new changes. 5. Pole License The
Director of Public Works reviewed 4 pole licenses that are being moved
to different locations at the Connors Mill Bridge site.
The licenses needed the Selectmen’s signatures as well as the
Town Clerk’s. 6. Cemetery Deeds Selectman
Carson moved to approve the sale of two deeds located in the New Waterloo
Cemetery totaling $500.00. Selectman
Hartman seconded the motion; all were in favor, the motion passed. 7. Manifest Selectman Hartman moved
to authorize the Selectmen to sign manifests and order the Treasurer to
sign payroll check numbers 1843-1876 (includes 9 direct deposit stubs)
in the amount of $37,096.41 and accounts payable check numbers
43141-43176 in the amount of $232,028.40.
Selectman Carson seconded the motion; all were in favor, the
motion passed. 8. Meeting Minutes Selectman Carson moved
to approve meeting minutes dated May 26, 2009.
Selectman Hartman seconded the motion; all were in favor, the
motion passed. Selectman Hartman moved
to approve three non public meeting minutes dated May 12, 2009, one was
called at 5:50 p.m., another at 8:13 p.m. and the last at 8:31 p.m.
Selectman Carson seconded the motion.
Jan Dyment asked if non-public sessions need to be posted 24
hours in advance. Selectman
Carson explained that any motion may be entertained during the course of
the Selectmen’s meeting. The
agenda does not have to be posted.
The fact that the Selectmen are meeting, the time and place are
relevant. Chairman Karrick
called for the motion; all were in favor, the motion passed. 9. Selectmen’s Other Business Selectman Hartman reported that the Nancy
Sibley Wilkins Trustees met on June 4 and approved a request from
Kearsarge Connection to help fund the distribution of their newsletter.
Selectman Hartman reported that he
attended the Northeast Resource Recovery Association conference on June
8 & 9. He said the
conference was well attended. Selectman Carson is working on putting
together a web-calendar that will list all meetings and activities in
Warner. Jan Dyment asked if the Selectmen are
working toward placing audio files back on the website.
Martha Mical said the Town did place audio files on the web-site,
because of the audio files the web-site crashed on two occasions and
needed to be reconstructed. So
instead there is a blurb on the web-site located under meeting minutes
stating that audio files upon request are available at the Selectmen’s
office. Jan Dyment asked
when an article is passed at Town Meeting what is the procedure if it is
not being honored. Chairman
Karrick said the Town has made a best effort to fulfill the terms of the
article. Selectman Carson reported that the Energy
Committee submitted some ideas to the Planning Board in regards to a
green energy ordinance. The
Planning Board responded back with two areas of interest one being
incentives for utilizing green energy in new construction and the other
was to relook at the existing ordinance for areas of change that will
enable the use of more green energy.
The Energy Committee will attend a meeting on June 20 in Concord
along with other area Energy Committees. Selectman Carson attended a Selectmen’s
workshop on June 6. At the workshop he spoke with a lawyer about the temporary
structure policy Selectman Carson is creating.
The lawyer said the Selectmen did fine with creating a policy but
his preference would be in the absence of zoning let the Zoning Board
make the decision. Martha
Mical recommended that the Selectmen send what they create for a policy
to the Planning Board for ordinance consideration. Selectman Hartman reported that on
Wednesday June 10th at 9:00 a.m. the Odd Fellows Building
Committee will meet. Selectman Hartman also reported there is
an operating committee meeting at Concord Regional Co-op at 1:00 p.m. on
June 10. A proposal for a
single-stream recycling project will be available for public review.
Barbara Annis reported that three members
of the Planning Board will meet with representatives from DOT.
The Planning Board would like documentation from DOT regarding
exit 9 and funding; they have only received verbal communications.
Martha Mical presented a Timber Tax
Warrant and a Gravel Pit Tax Warrant.
Martha Mical presented a request from the NH Telephone Museum
asking the Selectmen to consider tax exempt status because as of
February of this year the front portion of the museum is no longer
privately rented. The due
date for such a request is April 1.
Selectman Hartman moved to
abate $329.48 for the first tax bill of 2009 as requested by the NH
Telephone Museum. Selectman
Carson seconded the motion. All
were in favor, the motion passed. Judith Rogers commented about the increase
in fees at the Transfer Station she feels it is unfortunate.
She also recommends when the recycle brochure is updated to
include the option for no fees for dismantled items.
Martha Mical added that a list of alternative programs could be
listed within the brochure. Jerry Marsh is concerned about increased
illegal dumping that could arise from increased fees.
Allowing supervisor discretion in regards to fees may help. 10. Adjournment Selectman Hartman moved to adjourn the
