Warner Board of Selectmen Meeting Minutes June 20, 2006
Meeting opened at 7:00 p.m. In attendance: Selectman David E. Hartman – Chairman and Selectman Richard A. Cook Town Administrator, Laura Buono Recorder of the minutes is Mary Whalen Others present: Robert Firth Jim McLaughlin & Brian Hotz – Conservation Commission Judith Rogers – Town Clerk Mr. Firth met with the Selectmen as a follow-up from the May 23rd Selectmen’s meeting. Mr. Firth is scheduled to close on a construction loan on June 28th. Currently the house site is pretty much cleared. Mr. Firth is debating the foundation, he may change to a full foundation based on the condition of the site (currently the building permit signifies piers). Mr. Firth indicated that he moved the location of the house by about 200 feet. Selectman Cook reminded Mr. Firth that the septic design will now need to be amended. Chairman Hartman explained that the approved building permit is not for the location that Mr. Firth is intending to build upon, because he has made substantial changes the permit needs to be amended and reviewed by the Building Inspector. Mr. Firth feels that changing the septic design should not limit him from building the home. Selectman Cook explained that because he is moving the location of the septic system the move voids the current septic design and the building permit. Selectman Cook recommends that Mr. Firth contact the State, explain the issue, if the approval number remains the same, then Mr. Firth may proceed. If the State says the approval number is no longer valid then the building permit is not valid. Mr. Firth is asking the Selectmen to extend the deadline for the travel trailer. Chairman Hartman explained that since Mr. Firth has shown evidence of a construction loan and is progressing forward he may remain on the property during the process of building his home. Selectman Cook recommended amending the "Memorandum of Understanding". Selectman Cook made a motion to extend the deadline by which Mr. Firth needs to receive his certificate of occupancy to May 31, 2007 based on the validity of the existing building permit. Chairman Hartman seconded the motion. The motion passed. Selectman Cook asked Mr. Firth to amend the current building permit with the new location of the home in relationship to abutters and the road. Jim McLaughlin met with the Selectmen on behalf of the Conservation Commission which would like to spend some of the Conservation Commission Fund for a natural resource inventory. State Law actually places upon Conservation Commissions to complete a town wide inventory of natural resources. Once the inventory is completed a conservation plan can be completed which is part of the Master Plan. The Commission has sent bid proposals to the Forest Society, Central NH Planning Commission and the University of NH (UNH declined). The Forest Society bid was very detailed. The Planning Commission’s bid was not fully satisfactory. The Commission accepted the Forest Society bid totaling $9,135.00. Mr. McLaughlin asked the Selectmen to sign a "Memorandum of Understanding" between the Commission and the Forest Society. Martha Mical asked if the inventory involves walking on private property. Mr. McLaughlin explained that some features would require input from the Town, but does not believe it would involve private property. Selectman Cook read aloud what would be mapped; aerial photography base map, protected land and recreation features, forest & farm resources, water resources, wildlife habitat, scenic resources, parcel and zoning districts. Mr. Hotz explained that individual properties will not be inspected to find rare endangered species. Selectman Cook made the motion to sign the Memorandum of Understanding recommended by the Conservation Commission dated May 30, 2006 for the completion of a natural resources inventory for the Town of Warner. Chairman Hartman seconded the motion. The motion passed. The Selectmen forwarded information regarding a potential land donation for the Commission’s review. Chairman Hartman explained that Selectman Eigabroadt did complete a site visit of the Haight property on June 17th. Selectman Eigabroadt did take photographs of the property and verified that the pipe exiting the bathroom is no longer connected to a system under or away from the building. The Board needs to determine the next step. The property owners are now being taxed for a building on the property. The Selectmen will wait to hear from Selectman Eigabroadt about his site visit. Administrator’s Report Kearsarge Regional Preschool Program – Sue Gleason from SAU #65 has sent in a request to use the Warner Cooperative Preschool classroom on Wednesday’s & Thursday’s from July 5th to July 27th from 8:00 a.m. – 3:00 p.m. for a preschool special education program for approximately 10 students with 5 staff persons. The Selectmen approved the use and recommended first checking with Ed Mical for any date conflicts. Assessing – Martha Mical has set up a meeting with the Department of Revenue Administration on Tuesday, June 27th @ 9:00 a.m. with regard to the draft report on the review of assessment practices for Warner. DRA would like the Selectmen to be present for this meeting if possible. A copy of the material from DRA has been given to the Selectmen for review. Deputy Health Officer – The paperwork was already processed which appointed Ed Mical as Deputy Health Officer, however, there was a note on it from Selectman Eigabroadt stating that he has a comment with regard to pay. The Selectmen will review comment from Selectman Eigabroadt at the next scheduled meeting. FEMA – A FEMA official will be meeting with Allan Brown and Ed Mical on Thursday of this week to view the sites that were damaged from the most recent flooding. Employment Law Update – The TA attended an Employment Law Update on Monday morning at the Local Government Center which gave a brief overview of what’s new in labor law. A copy of the material is in the Selectmen’s read file. There was much discussion on Uniformed Services Employment and Reemployment Rights Act (USERRA) which deals with employees that get called to serve in the military and the laws that protect their jobs. Bock Real Estate Transfer – The Selectmen signed the paperwork for the real estate transfer for the Bock parcel. Safety Summary – Safety Summary has been filed. The Department of Labor inspector will be back on July 13th. Policies – The TA continues to work on the personnel policy and hazardous waste policy. The TA obtained a personnel policy from LGC and will compare with the policy with Warner’s. The final draft of the purchase policy will be presented at the next Selectmen’s meeting. Potential Land Donation – A call was received last week with regard to a potential land donation. The parcel is Map 7 Lot 44 owned by Herbert Goodwin Revocable Trust. It contains 2.2 acres of wetland. The Conservation Commission will look at the property and return their input. Selectman Cook recommends a meeting with the Director of Public Works to begin work on the Road Committee. It was agreed to meet on June 27th after meeting with DRA. Selectman Cook informed the Board that the USS Kearsarge will be in Boston. The Legion is involved with planning some activities. Selectman Cook made a motion to approve meeting minutes dated June 6, 2006 as corrected. Chairman Hartman seconded the motion. The motion passed. Selectman Cook made a motion to approve non-public meeting minutes dated May 30, 2006. Chairman Hartman seconded the motion. The motion passed. The Selectmen finished reviewing 2005 abatement requests. Selectman Cook made the motion to accept the recommendations submitted by the Assessor as applied to abatement requests for Map 28 Lot 11, Map 30 Lot 49, Map 16 Lot 64, Map 16 Lot 65, Map 28 Lot 39, Map 28 Lot 9 and Map 28 Lot 15. Chairman Hartman seconded the motion. The motion passed. Selectman Cook made the motion to reimburse Louis Monge $9.00 for overpayment on a new vehicle registration. Chairman Hartman seconded the motion. The motion passed. The Town Clerk presented a list of unlicensed dogs to the Selectmen. The Town Clerk will begin the calling process. Chairman Hartman asked Martha Mical if the fines are mandatory in regards to the taxable inventory forms. Martha explained that the fines will be applied to those forms received after the April 20th deadline. Adjournment at 8:40 p.m. Board of Selectmen
