Meeting Minutes

August 16, 2005

 

Meeting opened at 6:00 p.m.

In attendance: Selectman Wayne Eigabroadt – Chairman (arrived late), Selectman David E. Hartman and Selectman Richard A. Cook

John Place asked for further clarification regarding the 155B Order that was issued to Bryon Ruff and Wendy Place. Within the 155B Order the persons responsible have 20 days to respond if they are in disagreement of the order; otherwise the persons responsible have 60 days to come into compliance. After the twenty days the Town of Warner will file for Summary Motion of Enforcement, if granted, the Town will have the authority to enforce the order. Mr. Place asked what is further needed to allow the property owners to move back in to the structure. The Selectmen explained once the condition of the home is approved by the Health Officer and the improvements are signed off by the Building Inspector, and the conditions on the outside are not being a threat to the children (garbage) entry would then be allowed. The condition of the property still needs to come into compliance within the 60 days. Mr. Place asked how Ms. Place can reclaim the animals that were taken by the State Veterinarian. The Selectmen explained that the State would need to be contacted. The State reported that the animals, after examination, were fed at best twice a week, no provisions of water on site at the time of the removal and no shelter provisions for the animals were provided. The animals were seized based on these conditions and other health conditions. Mr. Bologna asked if the time allotted to work on the house could be extended a little later. The Selectmen discussed that request and the general consensus was to keep the time until 8:00 p.m.; there is no outdoor lighting.

Mr. Morrison met with the Selectmen regarding the condition of Newmarket Rd. where it intersects with Horne Street. Selectman Hartman explained that the Director of Public Works has filed for a wetlands permit. The Highway crew will be at the site within one week to resolve the culvert issues. Mr. Deangelis commented that the three culverts have been blocked for over a year.

Selectman Hartman made the motion to approve meeting minutes, work session and non-public dated July 26, 2005, July 27 & August 2 work session and August 2 meeting minutes. Selectman Cook seconded the motion. All were in favor. The motion passed.

The Selectmen learned that continued access on Town property becomes a Class III road, the Town would then be exposed to no more liability than for any other road. There are also no prescriptive rights or adverse possession against the public. A letter will be sent to the property owners located on Map 14 Lot 16 explaining that use of Town property will be permitted noting that the Town can end the access at any time. Also, the property owners will be responsible for any maintenance from their use. This access will also end when the property changes ownership.

The Selectmen’s office will send the annual leases to Kearsarge Children’s Center and the Warner Co-operative Preschool. The lease will be signed and returned to the Selectmen’s office for proper processing. The Selectmen did not to make any changes to the leases regarding cost and square footage.

The Selectmen reviewed their Capital Improvements for 2006-2011. The Selectmen recommended combining the chimney work for the Old Grade School and the Town Hall and present the request on one form. Selectman Cook made the motion to approve the Board of Selectmen’s Capital Improvements Plan for 2006. Selectman Hartman seconded the motion. All were in favor. The motion passed.

The Selectmen reviewed a Self-Analysis Performance Review form. These forms will be completed by the office staff and the Department Heads and will be used as a tool when the Selectmen are preparing their Performance Evaluations. The documents will require completion from the staff no later than September 1st.

The Selectmen reviewed a Land Use Change Abatement Request for Map 9 Lot 35. After reviewing the State Statues the Selectmen agreed to deny the request.

The Conservation Commission recommended that DES Fact Sheets on the Shoreline Protection Act and the State Wetlands Regulations be handed out with intents to cut and building permits as needed. The Selectmen’s office agrees and will begin to forward the information as needed.

Selectman Hartman made a motion to accept the land use change tax on Map 9 Lot 007-2. Selectman Cook seconded the motion. All were in favor. The motion passed.

Selectman Cook made the motion to accept application for Veterans Exemptions for Map 20 Lot 6-6 and Map 3 Lot 4-2. Selectman Hartman seconded the motion. All were in favor. The motion passed.

The Selectmen will review the final version of the Town Administrator job description.

The Selectmen have received a list of activities that may be in violation of an Enforcement Order on Map 3 Lot 88-1. The Selectmen will review and determine if the activities are in violation.

Selectman Hartman made the motion to accept the bid proposal submitted by Provan & Lober in the amount of $1,200.00 to complete the survey of Old Davisville Road. Selectman Cook seconded the motion. Funding for the project still needs to be determined, if needed, the project will be budgeted for 2006. All were in favor. The motion passed.

Selectman Cook continues to contact DES to arrange a meeting with them regarding the recent Transfer Station deficiency letter.

Legal advice will be sought regarding the Lativian Camp. The camp has yet to file the required tax exempt religious status forms. There is a deadline that needs to be met.

Selectman Cook contacted Local Government Center (Paul Saunders) about driveway permits. The Director of Public Works can require driveway modifications for safety. Also, Selectman Cook learned that the Petition received for increasing the Veterans Exemption needs may be on the Warrant but requires a vote.
