Meeting Minutes

October 4, 2005

 

Meeting opened at 6:00 p.m.

Ms. Bohman met with the Selectmen to discuss a culvert that is draining onto her property located on Iron Kettle Road. Ms. Bohman explained that the culvert is draining onto her property and depositing sand. Ms. Boham feels that the dug well which is located under where the water and sand is being deposited is at risk of contamination. Ms. Bohman has not had the water tested. Selectman Cook explained that the water coming out of the culvert is part of the natural drainage of the terrain which makes its way toward a small wetland between the Bohman property and the abutter. The Bohmans would like to work with the Town and have a drainage ditch created from the culvert diverting the water to another culvert. Mr. Brown explained that a swale constructed from crushed stone by the previous owners has probably failed. The Board explained that the wet area on the Bohman property is the owner’s responsibility. Because the culvert and drain is pre-existing, (the previous owners gave permission to install the culvert) means the culvert stays. If material is being deposited onto the property, the Town can clean the material when it occurs, within reason. The water might also be diverted to run past and behind the property. The Town’s responsibility ends at the culvert. The landowners would need to deal with any damage due to natural drainage. The Board explained that a wetlands permit would be needed if the property owners plan to excavate near a wetland. Selectman Cook referred Ms. Bohman to Sarah Allen (Conservation Commission, Wetland Scientist) to determine if the area is actually a wetland. Ms. Bohman asked the Board of Selectmen to consider further paving Iron Kettle Road in the near future. Mr. Brown explained that it is the Highway Department’s intent to remove some of the ledge the jutts out into the road, but cannot commit to a date at this time. Ms. Bohman thanked the Board for their time, and appreciates the time that has been spent on Iron Kettle Road.

Fred Arnold met with the Selectmen and first commended Allan Brown as the Director of Public Works. Mr. Arnold lives on the corner of Newmarket Road and Retreat Road. Speeding has been a continuing issue on Newmarket Road. Mr. Arnold has reported the speeding vehicles on numerous occasions. In 2003 Mr. Arnold presented a petition to the Selectmen asking to have the speed limit lowered. The Highway Safety Committee recommended instead increasing police patrol on Newmarket Street. Mr. Arnold noted that the Town of Sutton and the Town of Antrim have lowered speed limits. Mr. Arnold hopes that the speeding does not result in a serious accident. Selectmen Hartman explained that the Selectmen have recently spoke with Police Chief William Chandler about needing to deal with speeding in certain areas of the Town. The speeding on Newmarket is more prevalent in the early mornings and early evenings. At this time the Selectmen will ensure that Newmarket Road be put on target patrol by the Police Department. Mr. Arnold inquired about a piece of construction equipment that has been sitting over a year on a piece of property located on Newmarket Road. The Selectmen’s office will research the Zoning Ordinance regarding the equipment. Mr. Arnold also asked the Selectmen to use a very sharp pencil when creating the 2006 budget.

Selectman Hartman seconded the motion. All were in favor. The motion passed.

Selectman Cook made the motion to approve a request submitted by Alan Jones from Knoxland Equipment for 6 temporary storage trailers located on Map 3 Lot 33 or 34 to be placed as shown on the plan submitted with the application. Selectman Hartman seconded the motion. All were in favor. The motion passed.

The Selectmen agreed that a non-public session is necessary to discuss what questions will be asked during the Town Administrator interviews that are scheduled for October 6, 2005. Chairman Eigabroadt made the motion to recess the public session. Selectman Hartman seconded the motion. All were in favor. Selectman Cook made the motion to go into non-public session per RSA 91-A:3 II (b). Selectman Hartman seconded the motion. The motion passed.

Selectman Cook made the motion to close the non-public session and open the public session. Selectman Hartman seconded the motion. All were in favor. The motion passed.

The Selectmen’s secretary informed the Board that she received a message from Mr. Naughton explaining that he was in receipt of the letter sent by the Board dated September 20, 2005. In the message Mr. Naughton did state that he is not storing commercial vehicles on his property and would be willing to meet with the Board if so desired. Selectman Cook noted that he has not seen any commercial vehicles during the times he has passed by Mr. Naughton’s property, Chairman Eigabroadt and Selectman Hartman also have not seen any vehicles. The Board agreed that there is no need to meet with Mr. Naughton at this time.

The Selectmen approved the final draft of a zoning enforcement letter that will be sent to Mr. Abbondanza that gives a time limit toward the removal of material on his land located on Morse Loop. The letter regarding a reclamation plan will be forwarded soon after.

Selectman Hartman met with Attorney Matt Upton this morning regarding the Market Basket assessment. The Selectmen, Assessing Clerk and Mr. Upton will meet with Market Basket’s attorney to determine a fair assessment that is agreeable to all. The meeting will be scheduled for the end of October or early November.

Mr. Upton also informed Selectman Hartman that his presence is not needed regarding the Zoning Board re-hearing scheduled for October 12, 2005.

Selectman Hartman made the motion to the 2006 Guaranteed Annual Tonnage to the Solid Waste Co-op at 2,150 tons. Selectman Cook seconded the motion. All were in favor. The motion passed.

The Selectmen signed the 2005/2006 Warner Co-operative Pre-school lease.

The Selectmen approved a purchase order for a replacement windshield for the 86 Mack.

The Selectmen renewed a Building Permit for Map 7 Lot 31-1-2.

Selectman Hartman and Chairman Eigabroadt received a complaint by both phone and email regarding the animals residing at Map 3 Lot 76.
