Meeting Minutes

October 18, 2005

 

Meeting opened at 6:00 p.m.

In attendance: Selectman Wayne Eigabroadt – Chairman, Selectman David E. Hartman and Selectman Richard A. Cook

Recorder of the minutes is Mary Whalen.

Mr. Zoller met with the Selectmen to inform them that two bridges located on Route 103 toward Bradford just past East Roby Road will be painted. Precautions will be utilized by containing the structure to prevent any lead paint from entering the streams. Work will begin in 2006. The bridges will be completed one at a time. Lane closures with a traffic light will be installed. This is a State funded project.

Selectman Cook made the motion to approve as corrected meeting minutes dated October 4, 2005 and work session minutes dated October 11, 2005. Selectman Hartman seconded the motion. All were in favor. The motion passed.

Ed Mical learned that FEMA would be in the area conducting preliminary assessments. Field representative Nancy St. Laurent visited three communities in Merrimack County and made the determination that there is enough damage for Merrimack County to be declared eligible to receive Federal disaster aid.

Property records will be researched regarding a piece of construction equipment that is parked in a residential area located on Newmarket Road. A resident that lives in the area inquired about the equipment during a Selectmen’s meeting.

The Selectmen also received a complaint about speeding on Newmarket Road. The complainant requested that the speed limit be lowered, this is the second request. This request will be forwarded to the Highway Safety Committee.

The Selectmen discussed the accumulative Transfer Station fees that amount to $421.00 from the Ruff/Place family. Chairman Eigabroadt and Selectman Hartman recommend billing the family for the whole amount. Selectman Cook would like more time to contemplate about the fees.

Mr. Firth met with the Selectmen to sign an amendment to a Memorandum of Understanding dated July 5, 2005. The Town Clerk notarized the signatures to the amendment.

Peter Wyman met with the Selectmen regarding a mobile home situated at 14 Pleasant Lane. A building permit was submitted and approved by the Selectmen; after, it was learned that the mobile home is an older model. The Selectmen will hold the building permit until Mr. Wyman supplies documentation that the mobile home meets Federal HUD Standards. Until such time Mr. Wyman will receive a letter as the landowner from the Selectmen explaining that the mobile home is in violation of Warner’s Building Code. Selectman Cook made the motion to draw up a notice of violation addressed to Pleasant Lake Estates LLC for a mobile home situated at 14 Pleasant Lane. A building permit will not be issued until documentation is received showing that the mobile home meets Federal HUD Standards, therefore until such time a Certificate of Occupancy cannot be obtained for the mobile home. Selectman Hartman seconded the motion. All were in favor. The motion passed.

Selectman Cook made the motion to approve a building permit for Map 28 Lot 6. Selectman Hartman seconded the motion. All were in favor. The motion passed.

Mark & Erin Ruff met with the Selectmen regarding their lot that is listed as non-conforming. The Ruff’s would like to submit a building permit for a new home. The Selectmen explained that even though it is a non-conforming lot, a variance is still required from the Zoning Board because none of the set backs for the zone can be met.

Selectman Cook made the motion to approve a building permit for Map 10 Lot 23. Selectman Hartman seconded the motion. All were in favor. The motion passed.

Selectman Cook made the motion to approve a building permit for Map 3 Lot 31,32,34,35,42. Selectman Hartman seconded the motion. All were in favor. The motion passed.

Selectman Cook made the motion to approve an application for current-use for Map 17 Lot 35 & 37. Selectman Hartman seconded the motion. All were in favor. The motion passed.

Selectman Cook made the motion to approve the current Use Land Use Change Tax Lien release for Map 15 lot 37-1 and Map 15 Lot 37-2. Selectman Hartman seconded the motion. All were in favor. The motion passed.

Chairman Eigabroadt made the motion to sign the Timber Tax Levy Warrant as issued by the Tax Collector. Selectman Hartman seconded the motion. All were in favor. The motion passed.

Selectman Cook made the motion to sign and Intent to cut for Map 10 Lot 48. Selectman Hartman seconded the motion. All were in favor. The motion passed.

Selectman Cook made the motion to approve Pole License Petition #0530-2 for placement of one pole on Mink Hill Road in the Town of Warner. Chairman Eigabroadt added an amendment pending approval by the Director of Public Works. Selectman Hartman seconded the motion. All were in favor. The motion passed.
