MINUTES
DECEMBER 5, 2000

Chairman Nogues opened the meeting at 6:50 P.M.. All Selectmen were present, including members of the public.

Mr. David Gagnon met with the Selectmen to discuss the property on Poverty Plains Rd. that belongs to Mr. Gamil Azmy. Selectman Brayshaw has been working with Mr. Azmy on doing the paper work to convert the camp to a year round residence. At the September 26, 2000 Selectmen meeting Mr. Azmy was given 60 days to submit a permit application to the state to convert the camp to a year round residence. At this time the application has not been submitted. Mr. Azmy stated that he contacted the health department, and because there is an existing privy system state approval was not necessary, the Town would have to have their health inspector come in and look at it. Chairman Nogues informed Mr. Azmy that there is no documentation on record in the Selectmen’s office stating that Mr. Azmy has a State approved privy or septic system. Mr. Azmy stated that the current system falls under a grandfather clause. Selectman Brayshaw is trying to contact D.E.S (Department of Environmental Services) to verify that information. A pre-existing privy is adequate as long as the town’s health inspector has approved it, and that has yet to be completed. The question remains if Mr. Azmy’s property is a full time resident or a camp. Mr. Azmy stated that in 1998 he applied for a septic system, a building permit application was filled out but never signed pending a state approved septic design. Mr. Azmy stated that he will obtain a building permit application for a two-bedroom house and submit the current septic design to be approved by the State within a couple of days. Chairman Nogues stated with past information pertaining to the property on Poverty Plains it is still a summer camp, which means you can live in it six months out of the year. If Mr. Azmy has moved out of that residence then there are other legalities the Town needs to look into. Mr. Azmy stated that he still lives there. Chairman Nogues stated that the Selectmen have had requests from various residents from that area, and that Mr. Gagnon is meeting with the Selectmen to receive an update on those requests. Selectman O’Connor clarified with Mr. Azmy that he understands the steps to be taken 1. Approval of septic design. 2. Convert a summer camp to a year round residence. Mr. Azmy stated that he understood and will be taking the proper steps, Mr. Azmy agreed to submit a septic design to the State by Friday December 9, 2000. Selectman Brayshaw will be following up. The last issue is the wet lands on Mr. Azmy’s property. Sarah Allen from the Conservation Commission updated the Selectmen. Stumps need to be pulled out, and the side slope needs to be stabilized with top soil and seed. Sarah Allen will follow up with a letter to the Selectmen with an update on what needs to be done. A memo of understanding will be sent to Mr. Azmy listing what has been completed and what needs to be done.

Conservation Commission met with the Selectmen to give an update on the Fortin and Redman piece of land which is about 347 acres and their efforts to protect that piece of land. They are looking to get a conservation easement on it, but keep it in private ownership so the Town would not own the land just the easement to prevent future sub-division. The Commission had an appraisal done and made an offer to the land owner. The owner made a request of 20% down and a year to complete the financing. The Commission will find a private buyer and have a one day transaction where the Town will purchase the land and put an easement on it and sell it to the private buyer. There are several grant programs that the Commission is looking at to help them out in this process. The Commission received a call from Congressman Bass’s office who had heard about the project and they are very interested in helping to make this a forest legacy plan, the Commission will be meeting with Congressman Bass’s staff on 12-6. With a final agreement with the land owner a purchase and sales agreement will have to be signed by the Selectmen.

As things progress the Commission will keep the Selectmen updated.

Selectman O’Connor made the motion to put Mr. Ed Mical on permanent status as a Warner employee, Selectman Brayshaw seconded.

The Selectmen signed 1 building permit and 5 current use stewardships.

The Selectmen reviewed budgets:

General Government Bldgs-Town Hall, Selectman O’Connor made the motion to increase line 3 repairs from $5000.00 to $8500.00, Selectman Brayshaw seconded.

Town Officers Expenses-accepted as is.

Town Officers Salaries-accepted as is.

Building Inspector-accepted as is.

General Government Bldgs-Old Graded School-accepted as is.

Town Clerk-Chairman Nogues made the motion to change line 1 from $26,000. to $24,000. line 2 from $13.12 to $12.07 Selectman O’Connor seconded. Selectman Brayshaw made the motion to change line 12 from $249. to $000. Selectman O’Connor seconded.

Selectman Brayshaw contacted Market Basket and confirmed that the emergency road will be plowed by Market Basket.

Selectman Brayshaw made the motion to adjourn at 8:45 P.M., Selectman O’Connor seconded.
