Meeting opened at 8:30 a.m.

The TA updated the Board regarding a property owner’s
recent demise (Map 7 Lot 70-4). Relatives will be obtaining an attorney
for the estate. The bank involved has been notified of the Town’s
receipt of their check. The immediate family would prefer the Town to sell
the property using the proceeds to pay debtors along with demolishing the
dwelling. The TA explained demolishing the dwelling may not be an expense
the Town is willing to take on, but will be considered. It is still
unknown if the bank is interested/or has the right to redeem the property,
the bank attorney is researching. If the bank is able to redeem the
property then to follow through with that process would be in the best
interest for the Town. Legal opinion will be sought from the Town.
Chairman Hartman reported that he received a telephone
call from Robert Fletcher regarding the continued crowing of roosters at
an abutter’s property. Chairman Hartman advised Mr. Fletcher to contact
the Police Department, who will in turn determine if the complaint is a
civil matter, any zoning issues may be researched at the Town Hall.
Selectman Cook made a motion to go into non-public
session as allowed by RSA 91-A: 3, II (c), reputation. Chairman
Hartman seconded the motion. Roll call: Chairman Hartman, Aye; Selectman
Cook, Aye. The motion passed.
Selectman Cook made the motion to close the non-public
session. Chairman Hartman seconded the motion. Roll call: Chairman
Hartman, Aye; Selectman Cook, Aye. The motion passed.
Both Chairman Hartman and Selectman Cook proceeded to
the scheduled site visits at 9:00 a.m.
Return at 10:20 a.m.
The first site visit was with Mr. St. Lawrence at his
property located on Map 16 Lot 26, Ed Mical also attended. The elevation
of the structure needs to be determined by a licensed engineer. The
structure is located 19 feet on one end and 17 feet at the other end from
the edge of the high water mark. Mr. St. Lawrence indicated on his
submitted building permit that the structure was 35 & 25 feet from the
waters edge. The measured placement falls inside the State’s Shoreline
Protection Act regulation, the TA will be contacting the State. The
current placement of the structure also requires a variance. Selectman
Cook did explain to Mr. St. Lawrence that elevation certification is the
first step, because if that requirement is not met there is no question
that the Selectmen would require the structure to be removed. As a
community, cooperation of FEMA cannot be jeopardized. The State issue
needs clarification, which the TA will do. Then there is the question if
Mr. St. Lawrence meets both the elevation requirements and the State
Shoreline requirements would the Selectmen allow the structure to remain
while Mr. St. Lawrence appears before the Zoning Board for a variance.
Further deliberations will take place during a public meeting. The
Selectmen will also obtain clarification on the road that the structure is
situated near from the Director of Public Works (road set back). The TA
will send a follow-up letter to Mr. St. Lawrence giving a six week
deadline for the elevation verification (September 1, 2006).
The second site was Map 9 Lot 35; everything looked in
order as explained during the July 18th Selectmen’s meeting.
The September 15, 2006 deadline still stands for an approved septic
design.
